560 Rideau OMB Hearing

 

The Ontario Municipal Board hearing on the proposed 14-storey tower at 560 Rideau Street (at Cobourg) has concluded. Results won’t be available for several months but the Action Sandy Hill team is very encouraged.  Thanks to the support of more than community support eighty-five Sandy Hillers and friends of Sandy Hill, ASH was able to engage a lawyer, Joshua Moon, and an urban planner, Michel Frojmovic to present our case.

Background

City Council approved a 14-storey tower in August 2015 about a decade after a maximum of nine storeys had previously been approved. Around the same time the City launched a review of the Uptown Rideau Community Design Plan (URCDP) which includes Rideau Street from King Edward Avenue to the Cummings Bridge. The study concluded that the south side of Rideau Street between Chapel and the Cummings Bridge had little development potential due to the shallow lots on Rideau that abutted mostly low-rise heritage buildings on Besserer. Sadly, the URCDP included an exception to allow a 14-storey high-rise at 560 Rideau.

Hearing

Understanding the degree of community opposition and the precedents involved on such an important street, Action Sandy Hill (ASH) appealed Council’s approval of 560 Rideau, and the exception in the URCDP that allowed this, to the Ontario Municipal Board (OMB).

During the hearing City planners testified that as part of the URCDP review no independent modelling had been done on whether a high-rise would be appropriate on this site. They also confirmed that no assessment of the impact of the tower at 560 on the adjacent neighbourhood had been undertaken. It also became clear that the City’s Heritage group had not sufficiently considered the concerns raised in the Cultural Heritage Impact Statement prepared for the developer. They also had not seen or requested any illustrations of what visual impact the high-rise would have on the adjacent Heritage Conservation District.

ASH’s lawyer and urban planner outlined a clear argument; the City had no planning rationale for approving the 14-storey tower at 560 Rideau.

Summary

It may be several months before the OMB issues their decision on this appeal, and we know the OMB has a reputation for ignoring residents’ concerns, but those of us working on this are unanimous in our view that ASH was very well served by our professional experts. Regardless of the outcome, we could not have put forward a better case.


L’audience de la Commission des Affaires Municipales de l’Ontario (CAMO) sur la tour de 14 étages projetée au  560, rue Rideau (angle Cobourg) a eu lieu. Les résultats ne seront vraisemblablement pas disponibles avant pendant plusieurs mois, mais l’équipe Action Côte-de-Sable est très encouragée. Grâce à la contribution de plus de 85 voisins et amis de la Côte-de-Sable, ACS a pu retenir les services d’un avocat, Joshua Moon, et d’un planificateur urbain, Michel Frojmovic, pour présenter notre cause.

Contexte

En août 2015, le Conseil municipal autorisait  l’édification d’une tour de 14 étages, soit environ dix ans après qu’un maximum de neuf étages ait été approuvé par CAMO.  Vers la même époque, la Ville lançait une révision du Plan de conception communautaire Rideau (URCDP) incluant  la rue Rideau, allant de l’avenue King Edward jusqu’au pont Cummings.  L’étude  concluait que le côté sud de la rue Rideau, entre la rue Chapel et le pont Cummings, avait peu de potentiel de développement en raison des lots trop peu profonds longeant la rue Rideau, contigus, pour la plupart, à des bâtiments à caractère patrimonial, de faible hauteur, le long de la rue Besserer. Malheureusement,  l’URCDP comportait  une exception autorisant une hauteur de 14 étages au 560 Rideau.

Audition

Vu l’opposition de la communauté et considérant l’impact d’un tel précédent  dans une rue d’aussi grande  importance, Action Côte-de-Sable (ACS) a logé un appel auprès de CAMO,  contestant  la décision  du Conseil approuvant l’érection d’une tour au 560 Rideau, de même que l’exception prévue à l’URCDP permettant pareille autorisation.

Au cours de l’audition, les urbanistes de la Ville ont témoigné à l’effet que, dans le cadre de l’examen du plan de conception communautaire du secteur Est de la rue Rideau, aucune modélisation indépendante n’avait été menée sur l’à- propos d’un gratte-ciel sur ce site. Ils ont également confirmé qu’aucune évaluation de  l’impact de l’aménagement d’une  tour au  560 sur le voisinage environnant  n’avait été effectuée. Il est également apparu clairement que le groupe du patrimoine de la Ville n’avait pas adéquatement  tenu compte des préoccupations soulevées dans l’étude d’impact sur le patrimoine culturel, préparée pour le promoteur. De plus, ils n’ont ni vu, ni demandé  aucune illustrations de l’impact visuel de la hauteur sur le District de Conservation du Patrimoine adjacent.

L’avocat d’ACS a présenté un argument clair; par ailleurs, la Ville n’a pu fournir aucun motif pouvant justifier sur le plan « urbanisme » l’approbation d’une tour au 560 rue Rideau.

Résumé

Plusieurs  mois peuvent s’écouler avant que la CAMO ne rende sa décision sur cet appel, et nous sommes conscients  que la CAMO a la réputation d’ignorer les préoccupations des résidents. Cependant, ceux d’entre nous qui avons  planché sur ce dossier sommes  unanimes à dire  que nous aurions difficilement pu faire mieux.
